Mediation Philosophy
Myrna’s mediation philosophy is based on her extensive deal experience. It also leverages her work with clients from varying backgrounds and her deep appreciation for cultural sensitivities:
- Ensure parties can express all of their concerns and feel heard and attended to;
- Always keep in mind that we’re dealing with people even when parties are corporations;
- Work with the parties to ensure they have understood their own matters fully and that they base their positions on facts and not misperceptions or incomplete data;
- Ensure the parties have a realistic assessment of the alternatives available to them and, if relevant, available to the other party;
- Encourage parties to focus on their objectives and any goals they may share with the other party, and not be distracted by “noise” that is often detrimental to them;
- Always encourage “outside the box” thinking to bridge real and perceived gaps;
- Proactively support parties in crafting creative and workable solutions; and
- Manage the process to ensure momentum and commitment to the process are never lost.
